CIVIL

• Amber M. Swanson v. Nick Freitag. Dismissed without prejudice on March 11.

• OneMain Financial Group LLC v. James E. Marcus Jr. Dismissed without prejudice on March 11.

• Matt D. Hatala and Rowan Hatala v. City of Waverly d.b.a. Waverly Board of Hospital, Kelsey Masters, ARNP, Waverly Municipal Hospital d.b.a. Waverly Health Center. Dismissed with prejudice on March 18.

CIVIL — PROBATION VIOLATIONS

• Gabrielle Jeffery, 22, Charles City. Found in contempt of court for probation violation on an initial charge of criminal mischief-third. Ordered March 12 to serve 10 days in jail. A total $1,551.34 is owing in the case on a fine, surcharge and costs. Remains on probation.

• Corbin James Jones, 21, Marquette (docket) or McGregor (documents). Probation revocation issued March 20 on: A deferred judgment for possession of marijuana, less than 50 kilograms, with intent to deliver to a person under age 18 – a D felony – three to five years of prison deferred with probation. A deferred judgment for trafficking in stolen weapons – D felony – three to five years of prison deferred with probation. Jones was paid up on fines, surcharges, and costs of $2,014.80 on the related cases.

DISTRICT COURT

Andrew B. Eylers, 37, Cedar Falls, pleaded guilty March 10 to willful injury — causing bodily injury, a Class D felony. Sentenced March 24 to five years prison – suspended – with three years of supervised probation imposed. Ordered to pay costs totaling $1,518.96. A $1,025 fine was imposed but suspended. Pecuniary damages may be filed later, per sentencing. A no-contact order with the victim is extended to March 24, 2030.

MAGISTRATE COURT

Roshelle A. Swinton, 59, Waterloo, pleaded guilty to a lesser offense of theft – fifth degree, a simple misdemeanor. Sentenced on March 12, to serve 14 days jail, and ordered to pay the victim pecuniary damages of $8.96.

• Elijah D. Monroe, 48, Waterloo, pleaded guilty to theft – fifth degree, a simple misdemeanor, and was ordered on March 7 to pay a total $180.75 based on fine, surcharge and court costs.

• Lance A. Davis, 32, Waverly, pleaded guilty to assault (count one), a simple misdemeanor, and was sentenced on March 11 to serve seven days in jail, concurrently with count two. Davis also pleaded guilty to interference with official acts (count two), a simple misdemeanor, and was ordered to serve seven days in jail. Davis was ordered to pay fines, surcharges, court costs and restitution totaling $598.25, plus pecuniary damages not yet filed. A no-contact order between Davis and the victim was extended through March 10, 2030.

• Austin M. Wilson, 30, Cedar Falls, pleaded guilty on March 17 to theft – third degree (counts one and two), aggravated misdemeanors, and was sentenced to up to two years of prison on each count – suspended – to be served concurrently among counts one, two and four, and with a fine and surcharge on both suspended. Wilson also pleaded guilty in the judgment to child endangerment, an aggravated misdemeanor (count four) with up to two years of prison suspended and a fine and surcharge suspended. Court costs listed at $348.50. Pecuniary damages were not yet filed. Wilson was placed on two years of supervised probation. Count three was dismissed.

• Ryan J. Cheney, 35, Waterloo, pleaded guilty March 18 to two counts of theft-third degree. Sentencing is set at 1:30 p.m. April 22 in the Bremer County Courthouse.

Jeremy M. Smith, 36, Eldora, pleaded guilty to contempt of court – as amended, a simple misdemeanor, and was sentenced March 18 to seven days in jail and ordered to pay $258.90 in costs.

• Brittany C. Patton, 35, Waterloo, had probation modified March 18 to require that Patton participate and complete programming at the Fresh Starts Women’s Center Program in Des Moines, after having pled guilty in Marshall County on Sept. 23, 2024, to theft-second degree and possession of controlled substance-third or subsequent offense, each a Class D felony. Costs and pecuniary damages/restitution owed total $3,864.46.

• Vicente K. Leisen, 31, Minneapolis. Pleaded guilty to possession of a controlled substance – first offense – marijuana, and was sentenced on March 20 to five days in jail and ordered to pay $654.50 in a fine, surcharge and costs.

• Donte R. Farrow, 41, Waverly, pleaded guilty on March 21 to dog at-large, and was ordered to pay $180.75 in a fine, surcharge and costs.

• Elisha Boas, 25, Cedar Falls, pleaded guilty to operating while intoxicated – first offense, a serious misdemeanor, after a June 13, 2021, traffic stop, and was sentenced March 19 to two days in jail with the rest of a 90-day sentence suspended and ordered to pay $2,363.05 in a fine, surcharge and court costs. Two other non-speeding traffic charges were dismissed at Boas’ expense.

• Joeseph J. Berinobis, 56, Waterloo, pleaded guilty to operating while intoxicated – first offense, and received a deferred judgment on March 20. Berinobis was placed on one year self-probation and ordered to pay a civil penalty – with the amount to be halved if an interlock device is installed with proof in 60 days – and $100 court costs.
